Court Representation

Representation in Court

Appearing yourself?

It is permissible for any person to handle his own court case, in any court. However, bear in mind, the old adage "he who acts as his own attorney has a fool for a client". While many disputes involve complex legal issues, many cases are decided on the facts and not necessarily on the law and the task of the judicial officer is to determine who is telling the truth. One should not simply assume that a matter is simple, as frequently the law, or the facts, are more complex than first appearances suggest. It is therefor wise to invite the services of a lawyer.

Court Appearances are evoked in criminal, employment, civil or stautory matters. Engelbrechts Esselens Inc represent parties in all of the applicable forums. Labour, medical, civil and criminal representation is offered by Engelbrechts Esselens.

Civil Litigation

Civil litigation relates to a legal dispute between two or more parties that seek money damages or specific performance rather than criminal sanctions. A lawyer who specializes in civil litigation is a litigator or trial lawyer. Engelbrechts Esselens practise civil litigation and represent parties in trials, hearings, arbitrations and mediations before administrative agencies, foreign tribunals and federal, state and local courts. Delict could be a cause for litigation: e..g. personal injury: last mentioned as an example covers any wrong or damage done to another in his person, property, rights, or reputation. A personal injury can happen at work, in a traffic accident, because of a faulty product or a faulty repair, because of a mistake during medical treatment, or other negligenge. The personal injury can be physical or psychological but, to be considered actionable, it must occur due to the negligence or unreasonably unsafe actions of your employer, a manufacturer, your doctor, your landlord, or some other person or organization who owes you a duty of ordinary care. Examples of personal injury law causes of action include professional malpractice, wrongful birth, wrongful death, liable, slander, trespass, and nuisance.
Contract breach is another cause of action that might require litigation in a court of law, and consequent court representation.

Criminal Litigation

Criminal Law is the law that governs an individual's relationship to the state. It includes criminal offenses, which are established either statutory or by common law. Legal representation in criminal maters includes also applications for bail.

Labour and Employment Law

Employment law is the civil law that covers the laws and regulations governing labor relations and employment issues, such as collective bargaining, discrimination in the workplace, sexual harassment, occupational safety, wage and hour requirements, and workers' compensation. Disputes arising from the labour platform is appropriately addressed in the relevant forums, e.g. CCMA, arbitration or the Labour Court.
